Trademark registration

A business name or sign needs to be assessed in relation to the goods or services it identifies. Before applying for registration, it is useful to review available records and understand how the mark is used or will be used.

At Bernal Aquino, we advise on preparing and pursuing trademark applications before IMPI. We review the sign, ownership information and scope of the application to identify the decisions that need to be made.

Our approach to the matter

We assess the proposed name, logo or sign alongside the relevant goods and services. We review relevant prior records and explain observations that may affect the application strategy.

Documents for the initial review

  • The name, logo or sign to be registered.
  • A list of the goods or services the mark will identify.
  • Details of the owner and representative, where applicable.
  • Information about use and any previous IMPI files or communications.

A preliminary review informs the application, but IMPI decides whether to grant registration. Professional fees, official fees and included work are defined according to the engagement.

Questions about this service

What do you review before filing with IMPI?

We analyze the sign, its owner, the goods or services it will distinguish and the available prior records. This helps define the application and explain points that may need attention. The outcome depends on IMPI's examination; the preliminary review is not an approval.

Does follow-up include every office action or opposition?

The proposal specifies the work included and applicable official fees. If an office action or opposition arises during the process, we review it and explain the response required, whether it falls within the engagement and any additional work that would need to be agreed.
